1. Acceptance of terms
By creating an account you agree to these Terms and our Privacy Policy.
2. The service
Mongoose Commerce lets you run an online store: product pages, a cart and checkout, orders, customers, discount codes and store email. You can also link individual products to a checkout you operate elsewhere.
Checkout and payments. To take orders through your store’s checkout you connect your own Stripe account (and agree to Stripe’s own terms, including its Connected Account Agreement, when you set it up). Every sale is a payment to you, on your Stripe account: you are the seller and merchant of record, and we are not a party to any sale. We never hold your funds; Stripe pays them out to you. You are responsible for fulfilling orders, shipping, returns and refunds, customer service, disputes and chargebacks, and for collecting and paying any sales tax, VAT or similar tax that applies (Stripe Tax can calculate it at checkout if you turn it on in your Stripe account). Stripe’s own processing fees apply to every payment.
Platform fee. On the Free plan we charge a platform fee of 2% of the price of the items in each order (after discounts, before shipping and tax), taken automatically by Stripe from that payment. There is no platform fee on Pro. If you refund an order, the matching part of the platform fee is refunded too.
The Free plan is limited to 1 store, 25 products, 5 discount codes, 500 marketing emails a month and 5 AI requests per day. Pro ($19/month) allows up to 3 stores, 1,000 products per store, 200 discount codes, 10,000 marketing emails a month and 100 AI requests per day, removes the “Made with” note and the platform fee. Subscriptions are billed monthly through Stripe and can be cancelled at any time from your account; cancellation takes effect at the end of the paid period.
You can also get Pro as a 30-day pass paid with your Mongoose Card (19,000 Mongoose credits), which is run by Mongoose on mongooselabs.app under its own terms. The price is shown before you pay and nothing is charged without your confirmation; an agent acting for you can only ask, and you approve or decline in Mongoose. A pass does not renew on its own: buying again adds 30 days. When it ends your account returns to the Free plan limits for anything new; nothing you made is deleted.
3. Your content and your responsibilities
You own what you publish and you are responsible for it: that you have the right to sell it and to use every photo and description, that your listings are accurate, and that you comply with the consumer-protection, tax, privacy, product-safety and marketplace laws that apply to you and your customers.
Customer information and email. The names, email and shipping addresses and order details of your buyers are yours to use to fulfil and support their orders. You must handle them lawfully and only send marketing email to people who agreed to receive it (the newsletter confirmation and the checkout opt-in do this for you; do not upload or add other lists). Marketing email sent through your store includes your business postal address, which you must provide, and an unsubscribe link, which you must not remove or ignore. You must honour requests from your buyers to see, correct or delete their information.
Outreach (Pro). Outreach emails are sent only from a domain you own and have verified, in your name, and you are responsible for them. Only contact businesses or people you have a genuine business reason to contact, never buy or scrape lists, keep your messages truthful, and honour opt-outs (we record them and never send to an opted-out address again). Some places, including the EU and the UK, restrict unsolicited email to individuals much more strictly than the US: you must follow the rules that apply to the people you contact. We may pause outreach from a store that draws complaints or bounces.
Growth agent. If you turn it on, the growth agent writes (and in Autopilot, sends) campaigns to your subscribers on your behalf, within the limit you set. You remain responsible for what your store sends; turn it off at any time.
Imports. Only import a catalog from a store you own or are authorised to copy.
AI-written listings. The AI writer drafts text from the notes you give it. It can be wrong. Read every draft and correct it before publishing. You, not us, are responsible for the claims your listing makes.
Partner Desk
An invitation gives the named partner access to a private workspace to submit business introductions and see our team's review stages. Only submit contact information for someone who agreed to an introduction. Do not claim a connection, sale or endorsement that has not happened. A review stage is not a verified sale, commission balance, or promise to pay. Any referral fee or other commercial arrangement requires a separate written agreement; this page does not create one. We may revoke an invitation or session if it is shared, misused or no longer needed. A partner can request a copy or deletion of their Partner Desk data through the contact details on mongooselabs.app.
4. Prohibited use
You may not use Mongoose Commerce to sell or promote: counterfeit or infringing goods; illegal goods or services; weapons, explosives or controlled substances; stolen goods or personal data; adult sexual content; anything that is fraudulent or deceptive, including “stores” that exist to collect payments without delivering, or to imitate another business; malware or phishing; or anything else that harms shoppers. You may not link a Buy button to a page other than your own genuine checkout. We limit Buy links to known payment providers to help prevent abuse; attempts to get around that limit are a violation.
5. Reports, automated review and takedowns
Published stores are reviewed automatically, including by an AI model, and we check that Buy links still work and still lead to a payment provider. A product whose link has stopped working for several days is hidden until you fix it. Where the automated review is highly confident that a store clearly breaks these Terms (for example counterfeit goods, a scam, or illegal goods), it may suspend the store without prior notice; less certain cases are held for a person to review and the store stays online meanwhile. Suspensions are recorded with their reason and can be reversed if we got it wrong; if you believe yours was a mistake, use the contact details on mongooselabs.app.
Every store also has a public “Report this store” link. Reports help us prioritise what to review; they do not by themselves cause a takedown. We may hide, suspend or remove a store or product, with or without notice, if we believe it violates these Terms or the law, or puts shoppers at risk. If your store is suspended you cannot re-publish it. To report intellectual-property infringement, use the report link and include enough detail to identify the material and your rights in it.
6. Termination and deletion
You may delete your account at any time from your account page; doing so cancels billing and permanently removes your stores, products, orders, customer records and email history (download them first if you need them). Your Stripe account is yours and is not affected. We may suspend or terminate accounts that violate these Terms; if we do, we will give you a way to export your order records where the law and safety allow.
7. Disclaimer and limitation of liability
The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Mongoose Athanor LLC is not liable for indirect, incidental or consequential damages, for lost sales, or for the acts or omissions of merchants, payment providers or shoppers. Payment disputes, refunds and chargebacks are between the merchant, the buyer and Stripe.
8. Governing law and changes
These Terms are governed by the laws of the State of Montana, USA, where Mongoose Athanor LLC is organized, without regard to conflict-of-law principles. We may update these Terms as the product changes; continued use after a material change constitutes acceptance.
